現時世界各地出現前所未見的宗教迫害,皮尤研究中心發現,近年全球針對宗教信徒的政府和社會敵對正在增長。過去十年,基督徒比其他宗教群體在更多的國家-包括美國-受到滋擾,而在2016年,全球有一個或多個宗教群體在187個國家受到滋擾。1

對宗教自由的個別威嚇縱有不同形式和程度,其中一個普遍的來源是法律上和文化上對叛教、褻瀆,以及/或反皈依法的支持,這往往對人選擇以及/或改變信仰構成威脅。

  • 叛教法例懲罰那些「叛教」和皈依離開伊斯蘭的人,在許多穆斯林國家當中,憑藉社會壓力的支持,叛教法會用以制止叛教,甚至有時作為對此罪的指控的懲罰。這些法例阻止穆斯林自由選擇信仰,不論是選擇基督教或任何其他宗教。

  • 褻瀆法例一般防止對宗教的羞辱,而且是三種法例當中最普及的。在很多地區,雖然仍記錄在案,但經已沒有再實施和運用這些法例。但在其他地區,同樣是很多以穆斯林為大多數的國家,當宗教的少數族群被指控褻瀆神,這些法例就往往被濫用來解決不相關的糾紛和仇殺,而且通常在沒有證據的情況下。

  • 反皈依法,很簡單,就是防止人們皈依其他宗教。主要在印度教和佛教國家的一些地區,政府會用反皈依法來維持國家的大部份人口在其偏好的宗教中。2

雖然還有其他對宗教自由構成威脅的來源,但這三種法例以及它們背後的文化支持是自由選擇信仰的最主要威脅,也是全球宗教自由的最大威脅。

觸犯這些法例的懲罰包括婚姻無效、資產充公、監禁或死刑。有好些國家可以對觸犯這些法例判以死刑,包括阿富汗、汶萊、伊朗3、馬來西亞(某些州)4、馬爾代夫、毛里塔尼亞、尼日利亞、巴基斯坦、卡塔爾、沙特阿拉伯、索馬里、蘇丹、阿拉伯聯合酋長國5,以及也門。

此外,只要被指控觸犯,往往會帶來社區和家人的強烈社會敵對,他們的報復方式可由輕微的滋擾以至暴力而導致死亡。

因應大屠殺而草擬的《世界人權宣言》第18條宣稱,⸢每個人都有思想、良心和宗教自由的權利;這項權利包括改變其宗教或信仰的自由,以及單獨或在社區內與他人,不論公開或私下,在教學、工作、敬拜活動和宗教儀式內清楚表明其宗教或信仰的自由⸥6。這裡列出和敍述的法例是對《世界人權宣言》發表的宗教自由的直接威脅。

以下列出一些有把叛教、褻瀆、以及/或反皈依法記錄在案的國家,雖然這些法例未必仍被經常運用,而且有些已不太可能再運用,或是已被較優先的法律措施或憲法權利令其失效,但為了讓大家明白這些法例曾經或現時在哪些地方生效,她們仍被列在此文內。

在一些這等法例仍然實施或仍有影響力的國家,我們會舉出一些強行實施的例子以及它們對文化的影響,當我們明白這些法例如何運作,以及它們怎樣成為全球宗教自由的障礙之後,我們就能更有效提倡全球人民的自由。7

叛教法存在的國家

叛教法禁止和懲罰「叛教」行為,這幾乎只是針對懲罰有意擁護另一個信仰的穆斯林,因此這等法例是穆斯林得以自由選擇信仰-不論是基督教抑或任何其他信仰-的障礙。以下提及的國家,許多有法律明言禁止和懲罰叛教,有時甚至有死亡的威脅,其他很多雖沒有明言禁止叛教,卻有法例旨在阻止穆斯林轉投其他信仰,還有一些雖沒有這等法例,卻存在對抗和懲罰叛教的文化。

以下列舉的法例或許看似反皈依法,即這刊物提及的第三類法例。叛教法和反皈依法存在一些重疊 (它們的目的均旨在防止改變信仰),因此有些表面看似實施反皈依法的國家也會列舉在此,因為它們的反皈依法主要是由伊斯蘭對叛教法的教導所推動,目的主要是阻止穆斯林皈依其他宗教。叛教法跟最終一類的反皈依法的分別是,後者表面上阻止人民被欺騙或「誘使」從一個信仰轉到另一信仰。

褻瀆法存在的國家

這刊物提及的三類法例之中,褻瀆法是最大的,它廣泛地阻止「對宗教的羞辱」79。這裡列舉的國家,許多雖有在法律書上列明法例,但卻已沒有實施這些法例,或至少不會經常實施,或只偶爾實施。某些情況下,這些法例並不會成為決定性的法律條款(例如:在美國,假如褻瀆法被引用,幾乎必定引發第一修正案的挑戰,而這挑戰幾乎必定成功)。但在其他地方,同樣是許多以穆斯林為大多數的國家,這些法例仍然實施,而且當褻瀆法的指控是針對宗教少數族群而提出時,往往會在沒有證據的情況下被濫用,以解決紛爭和仇殺。

反皈依法存在的國家

反皈依法,很簡單,就是阻止人民皈依另一宗教。210反皈依法主要在部份印度教和佛教國家實施,是政府用以維持國家的大部份人口在其偏好的宗教之內。

這法例是假定用以防止人民被欺騙或「誘使」從一個信仰轉到另一信仰的,但許多時導致不鼓勵人分享其信仰-通常是針對很普通的傳教,理由是這是「誘使」人民作出的「欺詐性」皈依,因此,法例最終對分享個人信仰產生寒蟬效應,即使是以非強制的方式進行。211
